Indiana Lawmakers have passed laws that allow NIPSCO to Increase Fees. Many People are facing double and triple increases in their NIPSCO Bills this winter 2026 and are having extreme difficulty paying their bills. People in apartments face eviction, if their NIPSCO Bill is not paid. While NIPSCO states the increase is only only 16.74%, or $23 a month, local homeowners are facing 200% and 300% increases instead and NOT BECAUSE IT’S COLD! (See Temperatures and Fees on the NIPSCO Bills Below)
1. Bills HEA 1470 (2019);
(THIS IS THE ITSC FEE ON YOUR BILL)
Authored by: Rep. Edmond Soliday. Co-Authored by: Rep. Ethan Manning, Rep. Ryan Hatfield, Rep. Carolyn Jackson. Sponsored by: Sen. Mark Messmer, Sen. Andy Zay, Sen. David Niezgodski.
HEA 1470 (2019), along with other related bills passed in different sessions (such as SEA 423 in 2025), has been cited by consumer groups as a primary reason for significant increases in utility delivery charges, even when energy consumption remains flat. Opponents argue these laws enable NIPSCO to charge customers for infrastructure and planning costs before projects are operational, and sometimes even if projects are delayed or never completed.
Authored by: Sen. Eric Koch, Sen. Stacey Donato, Sen. Spencer Deery. Co-Authored by: Sen. Andy Zay, Sen. Susan Glick, Sen. Blake Doriot, Sen. Daryl Schmitt, Sen. James Buck, Sen. Jeff Raatz, Sen. Justin Busch, Sen. Gary Byrne. Sponsored by: Rep. Edmond Soliday.
SEA 423 (2025) allows utilities to recover costs from ratepayers, with some concerns raised by consumer advocacy groups about potential financial risks to customers. It permanently allowed approved develop costs for qualifying generation projects to be included in customer rates.

Stacey Donato, Sen. Randy Maxwell. Sponsored by: Rep. Edmond Soliday, Rep. Steve Bartels, Rep. Matt Lehman, Rep. Ryan Lauer.
SB 424 (2025) allows NIPSCO utilities to recover development costs for Small Modular Nuclear Reactors (SMRs), enabling upfront billing to ratepayers and risk shifting, which faced strong opposition from environmental groups and consumer advocates concerned about ratepayers funding unproven, expensive technology before project completion.
4. HEA 1007 (2025)
Authored by: Rep. Edmond Soliday. Co-Authored by: Rep. Chris Jeter, Rep. Sharon Negele, Rep. Randall Frye. Sponsored by: Sen. Eric Koch, Sen. Andy Zay, Sen. Stacey Donato, Sen. Jean Leising, Sen. Gary Byrne.
HEA 1007 allows NIPSCO to charge customers for pre-construction activities and costs associated with new nuclear projects even if the project is delayed or eventually fails, a provision that has drawn criticism from consumer advocates. It allows for “new generation resources” built to meet future demand, and recovering certain costs previously borne by shareholders. 5. HEA 1421 (2023) And SEA 271 (2022)

6. Senate Enrolled Act SEA 560 (Or 0560) (2013):
Authored by Senator Brandt Hershman, with Senator Jim Merritt and Senator Thomas Wyss added as coauthors.
Sponsored by Sen. Eric Koch,
Co-Sponsored by VanNatter, VanDenburgh, Battles
SEA560 Created The Transmission, Distribution, And Storage Improvement (TDSIC) Charge Allowing Utilities To Immediately Charge Consumers For 80% Of The Cost Of System Improvements Without Going Through A Rate Case. It allows utilities like NIPSCO to recover up to 80% of the costs for infrastructure projects through automatic “trackers” outside of traditional, formal rate cases.
To encourage utility infrastructure investment, the legislature created a new tracker (AKA FEE) called the Transmission, Distribution, and Storage System Improvement Charge (TDSIC). (Look at your bill, it’s on there)
It includes projects related to the following: โข Safety
โข Reliability โข System modernization โข Economic development Previously, these costs would have been included in rates for recovery in a base rate case. As a Result, utilities can petition for recovery on a more frequent basis. Both Indiana electric and Indiana natural gas utilities within Indiana have active TDSIC trackers.
7. HEA 1417 (2023)
Authored by: Rep. Edmond Soliday. Co-Authored by: Rep. Randall Frye. Sponsored by: Sen. Eric Koch, Sen. Chip Perfect.
This law significantly reduced the IURC’s authority to deny or reduce proposed rate increases. It allows utilities to self-approve and book nearly any expenditure, virtually guaranteeing cost recovery plus a profit from customers in future cases.
IN SUMMARY:
These were all Passed and allows NIPSCO to Recover the infrastructure and planning costs for Data Centers through DELIVERY FEES (See links below)
These rate increases have been sanctified by the Indiana House and the bills that they have passed in order for a NIPSCO to on collect from ratepayers (consumers) before they have even built the data centers. The customers of NIPSCO are paying for everything upfront whether they build it or not. NIPSCO is charging residents for it. They can charge all customers as long as they want because there’s no cap on it. NIPSCO does not have to justify how much money they charge.

According to the NiSource website . . .
“Amazonโs partnership with NIPSCO and GenCo is a cornerstone of this approach, enabling the development of data center campuses that will be powered by up to 3 gigawatts of new generation capacity to serve Amazonโs needs, with any excess generation enhancing grid reliability for all NIPSCO customers.” Click here for more
